Minutes of the Regular Meeting of the Council of the Township of Coleman held at the Council Chambers, 937907 Marsh Bay Road, Coleman Township, Ontario on Wednesday, November 26th, 2008 at 6:00 P.M.

Deputation: Ross Latter, Municipal Auditor

Mr. Latter was in attendance to present Council with his Independence letter and the terms of engagement covering the audit of the financial statements of the Township of Coleman for the fiscal year ending December 31, 2008. Mr. Latter explained that he would not audit the PSAB numbers but would submit a qualification statement on his audit report. He also informed Council that the financial statement for 2009 will look very differently from previous statements. The 2009 budget will be done separately and will not be included in the financial statements.

A discussion was held regarding the 2009 assessment provided by MPAC to Coleman land owners. Mr. Latter advised reducing the tax rates might resolve some of the concerns but a decision cannot be made until the assessment numbers are received.

Mayor Belanger thanked Mr. Latter for his presentation and addressing Council’s concerns .

Fire Chief Don Laitinen presented the following report:

– He advised a rental will be charged in the future when their furniture is used by people renting the hall – he would let Council know when a decision is made.

– He received a call from Mrs. Denton regarding the fire at the Recycling Plant during the summer. He advised he attended the fire on three separate occasions.

– The Coleman Fire Department was called to a highway vehicle accident on November 19th. He will be submitting his invoice to the Ministry of Transportation.

– A charge account has been opened at BNS Corner Gas and Dam Depot for gasoline for fire trucks.

– A First Aid Course will be held November 29th and 30th, 2008

BE IT RESOLVED THAT the minutes of the following Council Meetings be adopted as distributed: Regular Meeting – November 12, 2008 Special Meeting – November 13, 2008 Carried

A copy of the Sharp Lake Park service agreement was distributed to Council. This matter will be discussed at the next regular meeting of Council.

Mr. Cam Adams, Ministry of the Environment, was in the office to inspect the records for the Coleman Water Distribution System. He recommended some minor changes to the records which have been done.

WHEREAS the Corporation of the Town of Cobalt have submitted the Annual Compliance Report and the Municipal Summary Report for the Cobalt Water Treatment Facility;

AND WHEREAS the Council of the Corporation of the Township of Coleman has read the Annual Compliance Report and the Municipal Summary Report for the Cobalt Water Treatment Facility;

BE IT RESOLVED THAT The Corporation of the Township of Coleman approves the Corporation of the Town of Cobalt’s Annual Compliance Report for the Cobalt Water Treatment Facility for the year 2007 and the Municipal Summary Report for the Cobalt Water Treatment Facility for the year 2007 Carried

WHEREAS The Corporation of the Township of Coleman must designate an Operator in charge of the Cobalt Water Distribution System;

BE IT RESOLVED THAT Mr. Roger Lapointe or his Designate be appointed the Overall Responsible Operator for the Coleman Water Distribution System.

A copy of the funding application to Building Canada Fund submitted November 24, 2008, provided by Mr. Bruce McMullan, was distributed to Council. Council expressed concerns with the Water Users’ portion for the replacement/upgrading cost of the Coleman Water Distribution System.

Council reviewed correspondence from Kerry Schubert-Mackey – 2009 IPM Accommodations Team Chair regarding a free web-based Homestay posting service.

Mayor Belanger read a letter submitted to Mr. Kevin Pinkerton, Park Superintendent regarding the W.J.B. Greenwood Provincial Park. Council does not want Coleman lands to be adversely affected by the W.J.B. Greenwood Provincial Park project.

BE IT RESOLVED THAT the Clerk-Treasurer be authorized to purchase (20 lbs) turkeys for all Members of Council and Township Employees and hams for the Volunteer Firemen, also 2 turkeys and l ham for the Annual Christmas Dinner at the Golden Age Club December 25th. Carried..

BE IT RESOLVED THAT the following be appointed Fire Wardens for the Township of Coleman for the year 2009:

– Daryl Dufresne, Pete Nadeau and Brian Bigelow.

– Claire Bigelow, Daryl Dufresne, Christine Gagnon and Don Laitinen to issue burning permits.

WHEREAS Section 8 of the Municipal Act, 2001 states a Municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act,

BE IT RESOLVED THAT George Kemp from the firm Kemp Pirie and McLeod be appointed municipal solicitor for the corporation of the Township of Coleman for 2009. Carried.

BE IT RESOLVED THAT the Township Auditors be instructed to transfer surplus, if any, for 2008 to working capital reserve account, any deficit be withdrawn from working capital reserve account.

BE IT RESOLVED THAT Mr. Daryl Dufresne be appointed Weed Inspector for the year 2009.

BE IT RESOLVED THAT the Cobalt Coleman Community Policing Committee be donated $500.00 during 2009 to assist with their expenses. Carried.

BE IT RESOLVED THAT the Clerk-Treasurer be authorized to pay the honorarium to the Property Standards Committee for the year 2008. Carried.

Motion 08-11-28 MOVED BY Lois Perry and SECONDED BY Ron Beeson:

BE IT RESOLVED THAT the Clerk-Treasurer be authorized to pay all accounts presented to the Township up to and including December 31, 2008. Carried.

Motion 08-11-29 MOVED BY Ron Beeson and SECONDED BY Lois Perry:

WHEREAS significant charges have occurred to the process of reassessing of properties as a result of Bill 187 and Bill 44 introduced by the Government of the Province of Ontario;

AND WHEREAS the Canadian economy has been subjected to a severe downturn as a result of the global financial crisis;

AND WHEREAS the forecast is that the economy will deteriorate further in 2009 and is not expected to recover for a minimum of two years at the very least;

AND WHEREAS this recession will affect Ontarians’ day to day lives with ongoing job losses and wage decreases;

BE IT RESOLVED THAT the Council of The Corporation of the Township of Coleman fully supports The Corporation of the City of Cambridge’s call on the Honorable Dwight Duncan, Minister of finance of Ontario, the Honorable Dalton McGuinty, Premier of Ontario and the Ontario government to do what they can to help soften the blow for Ontario residents and property owners of all classes including, a deferral of the 4 year phase in for property tax increases by 1 year from the present phase in of 2009, 2010, 2011 and 2012 to 2010, 2011, 2012 and 2013. Carried.

BE IT RESOLVED THAT the Clerk-Treasurer be authorized to donate $500.00 to the Tri-Town Ski and Snowboard Club to assist with their expenses. Carried.

– Ministry of Finance regarding the release of the Report of the Provincial-Municipal Fiscal and Service Delivery Review providing information on the impact of its recommendations on the Ontario Municipal Partnership Fund.

– The Fifth annual CHALLENGE to ALL Businesses, Churches, Organizations, clubs & Individuals.

– Ministry of Finance regarding the agreement effective November 18, 2008 advising the City of Thunder Bay will assume property tax administration for Provincial Land Tax reform.

– Ontario Northland Economic and Social Impact Study which should be submitted by November 28, 2008.

– Mr. Derek Nardone, Public Affairs Officer, Egg Farmers of Ontario, regarding the Humane Society International’s letter of September 5, 2008 concerning the way farm animals are treated.

Mayor Belanger opened the meeting.

A discussion was held regarding snowmobilers travelling on the trails in the Township of Coleman. Mayor Belanger advised the Council of day had arranged with the Club that anyone can travel on the trail on Coleman land or Coleman roads without being charged.
