Minutes of the Regular Meeting of the Council of the Township of Coleman held at the Council Chambers, 937907 Marsh Bay Road, Coleman Township, Ontario on Monday, December 16th, 2013 at 6:00 P.M.

ADOPTION OF THE AGENDA 

Motion 13-12-20 MOVED BY Lois Perry and SECONDED BY Susan Cote:

BE IT RESOLVED THAT Council approves the agenda for the regular meeting of December 16th, 2013 as presented: Carried.

DECLARATION OF CONFLICT OR PECUNIARY INTEREST 

Councillor Perry declared a conflict with matters dealing with The Voice.

ADOPTION OF THE MINUTES

BE IT RESOLVED THAT THE General Accounts in the amount of $38,725.36 be passed and paid. Carried.

Motion 13-12-26 MOVED BY Susan Cote and SECONDED BY Lois Perry :

BE IT RESOLVED THAT Consent Applications B3-13, B4-13 and B5-13 (Dennis Kelly) be approved with the attached conditions.

AND FURTHER THAT Council approves Minor Variance Applications B6-13 and B7-13 (Dennis Kelly) Carried.

Motion 13-12-27 MOVED BY Susan Cote and SECONDED BY Lois Perry :

WHEREAS Council is in receipt of an appeal from the Town of Cobalt regarding the refusal of a Zoning By-Law Amendment to allow for the expansion of the Sharpe Lake Gravel Pit;

BE IT RESOLVED THAT the Council of the Corporation of the Township of Coleman:

1. Acknowledges the appeal from the Town of Cobalt

2. Affirms its decision to refuse the amendment as this decision is consistent with the Provincial Policy Statement, and conforms to the Northern Growth Plan, and Township’s Official Plan; and

NEW BUSINESS continued

BE IT RESOLVED THAT the Clerk-Treasurer be authorized to renew the Xerox Service Agreement – total base charge $26.50 quarterly and $0.0353/impression. Carried.

Motion 13-12-29 MOVED BY Susan Cote and SECONDED BY Lois Perry :

BE IT RESOLVED THAT the Clerk-Treasurer be authorized to renew the Neptune System Maintenance agreement in the amount of $3,005.80. Carried.

Motion 13-12-30 MOVED BY Susan Cote and SECONDED BY Lois Perry :

WHEREAS the Municipal Property Assessment Corporation is able to, and routinely adjusts assessed values for tax purposes for the current year and for up to two prior years on properties where development has occurred and a building permit has been obtained;

AND WHEREAS there have been several instances where development has occurred where no building permit has been obtained and has provided proof of the existence of development;

AND WHEREAS MPAC has advised that re-assessment will only apply for the following year and not be applied to the two previous years;

BE IT RESOLVED THAT the Council of The Corporation of the Township of Coleman fully supports the Township of Mulmur’s request that MPAC automatically and immediately re-assess all properties once the improvements have been discovered and apply the resulting increase to the current year and for the two previous taxation years;

AND THAT the onus be placed on the landowner to prove that the building has not existed for that entire time period. Carried.

The Ministry of Agriculture and Food advised the Application for Small, Rural and Northern Municipal Infrastructure Fund Capital Program has been refused.

The Cobalt Historical Society Report was deferred to the next meeting.
